1. Purpose.
This instruction provides a comprehensive
Department of the Navy (DON) policy for the use of Alternative
Dispute Resolution (ADR), and defines the authority, mission, and
functions of the Assistant General Counsel and the DON ADR
Program Office. This instruction has been substantially revised
and should be reviewed in its entirety.

3. Definitions
a. Alternative Dispute Resolution. Any procedure that is
used in lieu of a formal administrative process or litigation to
resolve issues in controversy, including, but not limited to,
partnering, conciliation, facilitation, mediation, fact finding,
mini-trials, neutral evaluation and arbitration, or any
combination thereof. For purposes of this instruction,
arbitration entered into under reference (a) is not included in
this definition.
